2021年9月，中国正式申请加入CPTPP，其中高标准的服务贸易规则就是加入受阻的掣肘之一。鉴于国情复杂、改革进程缓慢，作为制度创新试验田，海南自贸港在对接国际高标准服务贸易规则方面应当发挥示范和领先效能。在这方面，海南自贸港于2021年率先推出海南版的跨境服务贸易负面清单，为三年后推出全国版和自贸试验区版的跨境服务贸易负面清单积累了宝贵的经验。在当前中国积极寻求加入CPTPP的背景下，加快海南自贸港跨境服务贸易负面清单的制度创新，缩小与CPTPP所倡导的服务贸易规则差距，具有极其重大的意义。为此建议增强海南自贸港服务贸易负面清单的严谨性，减少在本地存在方面的禁限措施数量，以及全面提升透明度。一旦上述改革成功，可为全国提供可复制、可推广的经验。

China’s application to accede to the Comprehensive and Progressive Agreement for Trans-Pacific Partnership(CPTPP)in Sept. 2021 has again been rejected, among which the high-standard rules on trade in services constitute one of the major obstacles. Given China’s complex national conditions and the gradual pace of domestic reforms,Hainan Free Trade Port(HFTP), as experimental fields for institutional innovation, should play a demonstrative and leading role in aligning with high-standard international rules on trade in services.In this regard,HFTP took the lead in intro- ducing the Hainan version of the negative list for cross-border trade in services in 2021, there by accu-mulating valuable experience for the subsequent launch of the national and pilot free trade zone versions of the negative list three years later. Against the backdrop of China’s active pursuit of CPTPP accession, accelerating institutional innovation in the negative list for cross-border trade in services in HFTP and narrowing the gap with the rules on trade in services advocated by the CPTPP are of significant importance. To this end, this paper proposes such suggestions as enhancing the rigor of the negative list for trade in services in HFTP reducing the number of restrictive measures concerning local presence requirements; and comprehensively improving transparency. Once successfully implemented, these reforms may provide replicable and scalable experience for nationwide application.
