数字经济时代下新型劳动者劳动报酬权益保障研究 作者:李思琪

摘要/Abstract

在数字经济时代下,互联网技术不断发展,促进生产力要素变革,催生了许多新业态,拓展了就业新空间,为我国经济发展注入新活力。以互联网平台为依托,新型劳动者群体比例不断增加,提升就业机会的同时,也产生一系列问题,如劳动报酬算法机制不清晰、劳动报酬不稳定、劳动报酬克扣与拖欠问题、劳动报酬权益维护难度大。通过分析新型劳动者劳动报酬权益保障面临的现实困境,从完善劳动报酬权益保障法律法规体系、建立行业工会强化社会协同监管、创新平台企业规范化治理新路径、提升新型劳动者自身维权意识和能力方面提出应对策略,从而有效保障新型劳动者劳动报酬权益。


In the era of the digital economy, the continuous advancement of internet technology has driven the transformation of productivity factors, catalyzed numerous emerging business models, expanded new employment spaces, and injected fresh vitality into China's economic development. With the support of internet platforms, the proportion of new-type workers continues to increase. While enhancing employment opportunities, this trend has also given rise to a series of issues, including opaque algorithmic mechanisms for labor compensation, instability in remuneration, problems of wage deductions and delays, and difficulties in safeguarding labor compensation rights and interests. By analyzing the practical challenges in protecting the labor compensation rights and interests of new-type workers, this study proposes countermeasures from four dimensions: improving the legal framework for labor compensation rights protection, establishing industry-specific trade unions to strengthen collaborative social supervision, innovating standardized governance pathways for platform enterprises, and enhancing workers' awareness and capabilities in rights protection. These measures aim to effectively safeguard the labor compensation rights and interests of new-type workers in the digital economy.
