制定《学前教育法》已进入全国人大常委会的立法安排,这是考虑到学前教育在国民教育体系中居于重要的地位,但现有教育立法对学前教育缺乏具体规定。为此有必要制定一部《学前教育法》,进而在法治轨道上将学前教育事业不断推向前进。学前教育立法需要完成的核心制度设计有三,分别是为学前教育事业的发展确定相应的原则遵循,把“坚持保育和教育相结合”作为学前教育的主要内容,以及明确学前儿童、幼儿园、教职工和政府的法定职责。
The enactment of the Pre-school Education Act has entered into the legislative programmer of the Standing Committee of the National People's Congress, in view of the fact that pre-school education occupies an important place in the national education system, but that existing education legislation lacks specific provisions for pre-school education. For this reason, it is necessary to formulate a Law on Pre-school Education, and thus push the cause of pre-school education forward on the track of the rule of law. There are three core institutional designs that need to be completed in order to legislate on pre-school education, namely, to set out the principles to be followed in the development of pre-school education, to make the ‘combination of care and education’ the main content of pre-school education, and to clarify the statutory responsibilities of pre-school children, kindergartens, teaching staff and the Government.
