互联网时代下,诸多生活服务类平台利用算法机制,以海量数据为基础实施平台个性化定价。部分生活服务类平台存在的不公平定价行为不仅会损害消费者利益,甚至可能产生排除竞争的效果。是否需要反垄断法的介入,以及如何介入的标准在学界仍存在诸多争议。反垄断法规制的前提是具有市场支配地位。但平台经济在互联网因素的加持下往往呈现强不稳定性的特征,导致认定其市场支配地位的标准有待商榷。相关监管手段操作性差等问题也导致了反垄断法在涉平台个性化定价案件中的适用困难。因此本文将以明晰生活服务类平台个性化定价行为为基础,分析现有框架下存在的实践困境,在平衡好经济自由度与社会总福利的基础上提出推进涉生活服务类平台个性化定价案件的规制路径建议。
In the Internet era, many life service platforms use algorithms to implement personalized pricing based on massive data. The unfair pricing behavior of some life service platforms will not only damage the interests of consumers, but may even have the effect of eliminating competition. There are still many disputes in the academic circle about whether and how to intervene. The premise of anti-monopoly law regulation is to have a dominant market position. However, under the support of the Internet factors, the platform economy often presents the characteristics of strong instability, which leads to the standard of identifying its dominant market position to be discussed. Poor operability of relevant regulatory means also leads to the application of anti-monopoly law in cases involving personalized pricing of platforms. Therefore, based on clarifying the personalized pricing behavior of life service platforms, this paper will analyze the practical difficulties under the existing framework, and put forward suggestions on the regulation path of promoting the personalized pricing cases related to life service platforms on the basis of balancing the economic freedom and the total social welfare.
