论关贸总协定的历史地位与作用

关贸总协定在多边贸易体制发展史上的地位如何？又起过多大作用？WTO官方出版物对此问题的答复是："关贸总协定死了，关贸总协定万岁！"这与其说是一个明确的答案 不如说是一条聪明的谜语。为了释疑解惑，本文试图从国际法学者的视角对关贸总协定在多边贸易体制发展历程中的地位与贡献进行宏观和动态的分析，以便从历史角度加深对WTO法 和世贸组织的职能与特性的认识，从而进一步理解我国执行WTO协定所不可忽视的国际政治经济关系背景。
What is the historical role of the GATT within the multilateral trade system in its development process? The WTO gives the answer by its official publication as follows: "The GATT is dead, long live the GATT". The above reply is rather a smart riddle than a clear answer. This paper attempts to make a macro and dynamic analysis, from an international law scientist's perspective, of the r ole and the achievements of the GATT within the multilateral trade system in its development history，so as to deepen the understanding of the functions and features of the WTO and its law from a historical perspective, and to further under stand the significance of the international political economic context in which China implements the WTO Agreements.
